Welcome to Zisker. These Terms of Service (“Terms”) govern your access to and use of the website located at zisker.com, our client portal, and all hosting, infrastructure, domain, and related services provided by Zisker.

By accessing or using any Zisker services, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of our services immediately.


1. Definitions

For the purposes of this agreement:

“Zisker,” “Company,” “we,” “us,” or “our” refers to Zisker and its operators, affiliates, and service partners.

“Customer,” “Client,” “User,” or “you” refers to any individual or entity purchasing or using services provided by Zisker.

“Services” refers to all products and services offered by Zisker, including but not limited to:

  • Web hosting

  • Reseller hosting

  • Virtual private servers (VPS)

  • Domain name registrations

  • Email hosting

  • Website infrastructure

  • Cloud services

  • Technical support services

“Account” refers to a registered customer account created within the Zisker billing or service platform.


2. Acceptance of Terms

By creating an account, purchasing services, or using any services offered by Zisker, you confirm that:

  • You have read and understood these Terms.

  • You agree to be legally bound by them.

  • You agree to comply with all applicable laws and regulations.

These Terms apply to all customers and users of Zisker services.


3. Eligibility

To use Zisker services you must:

  • Be at least 18 years old or the legal age of majority in your jurisdiction.

  • Have the legal authority to enter into binding agreements.

  • Provide accurate and truthful information during account registration.

Zisker reserves the right to refuse service to anyone at its sole discretion.


4. Description of Services

Zisker provides hosting and infrastructure services that allow customers to host websites, applications, and digital content on internet-connected servers.

Services may include:

  • Shared hosting

  • Reseller hosting

  • VPS or cloud servers

  • Domain name registration

  • DNS management

  • Email hosting

  • Website infrastructure tools

Service features, pricing, and limitations are described on our website and within the client portal.

Zisker may modify, upgrade, or discontinue services at any time.


5. Acceptable Use Policy

Customers must use Zisker services in a lawful and responsible manner.

The following activities are strictly prohibited:

Illegal Content

Hosting or distributing content that violates any law including:

  • Fraud

  • Identity theft

  • Financial scams

  • Copyright infringement

  • Illegal drug sales

  • Child exploitation material

Malware and Hacking

Customers may not use Zisker services to:

  • Distribute malware

  • Host viruses

  • Conduct hacking attempts

  • Run exploit scripts

  • Operate phishing websites

Spam and Unsolicited Email

Customers may not use Zisker servers to send:

  • Unsolicited bulk email

  • Mass mailing without consent

  • Email marketing lists obtained illegally

Violation may result in immediate suspension.

Resource Abuse

Customers may not:

  • Run processes that excessively consume CPU or RAM

  • Conduct crypto mining

  • Run automated bots that degrade server performance

  • Use shared hosting as file storage unrelated to websites

Zisker may suspend services that negatively affect server stability.


6. Server Resource Usage

Zisker provides shared hosting environments where server resources are shared among customers.

Customers agree not to exceed reasonable resource limits including:

  • CPU usage

  • Memory usage

  • Disk I/O

  • Bandwidth usage

If a customer’s usage impacts other users, Zisker may:

  • Throttle usage

  • Request service upgrades

  • Suspend services temporarily

These actions may occur without prior notice when server stability is at risk.


7. Account Responsibilities

Customers are responsible for maintaining the security of their account.

You agree to:

  • Keep login credentials secure

  • Not share account access without authorization

  • Notify Zisker immediately of suspicious activity

Zisker is not responsible for losses resulting from compromised account credentials.


8. Payments and Billing

All services must be paid in advance.

By purchasing services you agree that:

  • All listed prices are in USD unless otherwise stated.

  • Payments are processed through our billing platform including Upmind.

  • Recurring services renew automatically unless cancelled.

Failure to pay invoices may result in service suspension.


9. Renewals

Many services renew automatically.

Customers will receive renewal invoices before billing.

If payment is not received by the due date:

  • Services may be suspended

  • Accounts may be terminated

  • Data may be deleted after expiration

Customers are responsible for cancelling services before renewal if they do not wish to continue them.


10. Refund Policy

Refunds may be offered according to Zisker’s Refund Policy.

Unless otherwise stated:

  • Setup fees are non-refundable.

  • Domain registrations are non-refundable.

  • VPS services may be non-refundable after provisioning.

Refunds may be denied in cases of abuse or policy violations.


11. Backups and Data Responsibility

Customers are solely responsible for maintaining backups of their data.

While Zisker may perform system backups for operational purposes:

  • Backups are not guaranteed.

  • Backup restoration is not guaranteed.

Zisker shall not be liable for:

  • Data loss

  • Corruption of files

  • Loss of databases

  • System failures

Customers must maintain their own backup systems.


12. Service Availability

Zisker aims to provide reliable hosting services but does not guarantee uninterrupted uptime.

Service interruptions may occur due to:

  • Hardware failure

  • Network outages

  • Security incidents

  • Maintenance activities

  • External infrastructure providers

Services are provided “as-is” and “as available.”


13. Suspension and Termination

Zisker may suspend or terminate services immediately if a customer:

  • Violates these Terms

  • Conducts illegal activity

  • Generates abuse complaints

  • Causes network disruption

Accounts may also be suspended for:

  • Non-payment

  • Fraud detection

  • Security risks

Termination may occur without prior notice in severe cases.


14. Abuse Complaints

Zisker investigates all abuse complaints including:

  • Spam reports

  • Malware distribution

  • Phishing websites

  • Network attacks

Customers must cooperate with abuse investigations.

Failure to respond to abuse reports may result in service suspension.


15. DMCA Copyright Compliance

Zisker respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) established by the United States Congress.

If a copyright owner believes their content is being hosted illegally, they may submit a DMCA notice.

Upon receiving a valid notice Zisker may:

  • Remove or disable access to the infringing material

  • Notify the customer responsible for the content

  • Suspend the associated account if necessary

Repeat infringement may result in permanent account termination.


16. Domain Registration

Domain name registrations may be subject to policies established by ICANN.

Customers registering domains agree to comply with all applicable domain registry policies.

Zisker is not responsible for:

  • Domain expiration

  • Domain disputes

  • Registry-level decisions

Customers are responsible for renewing domains before expiration.


17. Reseller Hosting

Customers purchasing reseller hosting are responsible for managing their own clients.

Resellers agree that:

  • They are responsible for the actions of their customers.

  • Abuse committed by reseller clients may result in suspension of the reseller account.

  • Zisker provides infrastructure but does not manage reseller customer relationships.


18. Chargebacks and Fraud

Customers may not file payment chargebacks without first contacting Zisker support.

If a chargeback occurs:

  • Services may be immediately terminated

  • Accounts may be permanently banned

  • Outstanding balances may be sent to collections

Fraudulent transactions may be reported to relevant authorities.


19. Intellectual Property

All content on Zisker.com including:

  • Logos

  • Branding

  • Software

  • Documentation

is owned by Zisker or licensed to Zisker.

Unauthorized use of our intellectual property is prohibited.


20. Third-Party Services

Zisker services may integrate with third-party providers including payment processors and infrastructure vendors.

Zisker is not responsible for the policies or actions of third-party services.


21. Limitation of Liability

To the fullest extent permitted by law, Zisker shall not be liable for:

  • Indirect damages

  • Loss of revenue

  • Loss of business

  • Data loss

Total liability shall not exceed the amount paid by the customer for services during the previous billing cycle.


22. Indemnification

Customers agree to defend and indemnify Zisker against any claims arising from:

  • Violation of these Terms

  • Illegal activity conducted using Zisker services

  • Intellectual property infringement


23. Modifications to Terms

Zisker may modify these Terms at any time.

Updated Terms will be posted on our website.

Continued use of services after changes indicates acceptance of the updated Terms.


24. Governing Law

These Terms are governed by the laws of the State of Florida, United States.

Any disputes shall be resolved in the courts located in Florida.
